Barber Law Group obtains judgment in favor of its client in all phases of four-phase Arizona case
The Arizona case of Nucor Corporation v. Hartford, et al , which was filed in 1997, was tried in four phases.  Phases I - III addressed Nucor's claim for defense costs, Barber Law Group client  Wausau's claim for contribution against Hartford and Travelers, and Nucor's claim for indemnity.  Despite vigorous opposition from Nucor, represented by Winston, Strawn, Fennemore Craig, the Court issued its Final Amended Judgment on Phases I - III on January 4, 2010,  holding that Nucor, as indemnitor of co-insurer Hartford, owes Wausau $4,047,337.63.  On January 13, 2010, Nucor and Hartford filed their respective notices of appeal of the Amended Final Judgment.  Wausau has filed its notice of cross appeal with respect to limited issues.

The Court bifurcated Phase IV from Phases I - III.  Phase IV addressed the claim of Nucor/Travelers  for contribution against Wausau.  On December 10, 2009, the Court granted Wausau's Motion for Partial Summary Judgment and denied Nucor's Motion for Partial Summary Judgment on Nucor's claim for contribution as assignee of co-insurer Travelers, thereby resolving all Phase IV claims in favor of Wausau.  On February 9, 2010, the Court entered final Judgment in favor of Wausau on Phase IV and further granted Wausau's request for attorneys' fees in the total amount of $366,366.63.
