Barber Law Group's favorable judgment in Santa Barbara case upheld on appeal; cert denied
The California Supreme Court denied Neal Feay's petition for reconsideration of denial of certiorari, finally exhausting Neal Feay's efforts to overturn the trial court's judgment in favor of Barber Law Group's client, Wausau.  Neal Feay originally claimed almost $2 million for past and current costs relating to groundwater contamination in Santa Barbara.  Wausau defended Neal Feay under an unusual umbrella policy provision that provided a defense for non-litigated claims.  Wausau sued Neal Feay for declaratory relief and ultimately obtained a favorable verdict at a bench trial in 2007.  Barber Law Group successfully argued that this verdict should stand through Neal Feay's appeal to the California Court of Appeal, its motion for reconsideration to the Court of Appeal, its petition for certiorari to the California Supreme Court, and its motion to reconsider denial of its petition for certiorari.
